Judge rules 3 percent retirement health contribution is unconstitutional

Siding with MEA members, a judge has ruled that the Legislature requiring an additional 3 percent contribution by school employees for retiree health insurance is unconstitutional.

Retired Ingham County Circuit Judge James Giddings, hearing the case, said the law passed last year took the property of public school employees without due process, violating the U.S. and Michigan Constitutions.

"We're pleased to see this decision come down on the side of public school employees and their families," said MEA President Iris K. Salters. "Even the Legislature has to follow due process of law."

It's unclear if the state will appeal the ruling, but if they do, "We will continue to fight not only this case, but all attacks on public education, school employees, students and the middle class at large," Salters said.
